#1: Preamble

Preamble: Definitions

Each of the terms mentioned below will have the following meaning in these General Terms and Conditions of Use of the Sateesfy Donations Service (hereinafter referred to as the "Terms"):

Announcement: refers to all elements and data (visual, textual, audio, photographs, drawings), submitted by an Advertiser under their editorial responsibility, for the purpose of declaring a lost or found object, property, animal or person.

Advertiser: refers to any individual of legal age or legal entity established in Cameroon who has submitted and published an advertisement via the Sateesfy Donations Service. The term "Advertiser" in the Terms and Conditions encompasses both types of Advertisers submitting advertisements via the Sateesfy Donations Service, namely:

• The term "Private Advertiser"refers to any individual of legal age and mental capacity to use such a service, acting exclusively for private purposes and having posted an Advertisement on the Website. All Private Advertisers must have a Personal Account to post and manage their Advertisement(s).
• The "Professional" Advertiser: This refers to any individual of legal age and mental capacity to use such a service, according to Cameroonian regulations, who posts advertisements exclusively for professional purposes on the website. All Professional Advertisers must have an account to post and manage their advertisement(s). The following activities may be considered professional activities:
• Regular dissemination of information collected on our site to third-party websites
• Regular declarations of a large volume of items,
• Declaration allowing for the generation of profits and the release of substantial income.

Account: refers to the free space, accessible from the Website, which every Individual or professional Advertiser must create, and from which they can publish, manage, view their ads, and subscribe to one or more paid option(s).

Sateesfy: refers to the company that publishes and operates the Website.

Sateesfy Donations Services: refers to the Sateesfy Donations services made available to Users and Advertisers on the Website.

Website: refers to the website operated by the Company and the Sateesfy brand, accessible mainly from the URL www.sateesfydons.com and allowing Users and Advertisers to access the Sateesfy Donations Service via the internet.

User: refers to any visitor, having access to the Sateesfy Donations Service via the Website and consulting the Sateesfy Donations Service, accessible from the different media.

#2: Article 1 Purpose

The purpose of these Terms and Conditions is to determine the conditions of use of the Sateesfy Donations Service made available to Users and Advertisers via the Website.

The terms and conditions for Advertisers to subscribe to paid options (hereinafter referred to as "Paid Options") are set out in the general terms and conditions of sale reserved for:

#3: Article 2 Acceptance

By accessing and using the Sateesfy Donations service via the Website, all Users and Advertisers declare that they have read and expressly accept these Terms and Conditions of Use without reservation or modification of any kind. These Terms and Conditions of Use are therefore fully enforceable against Users and Advertisers.

#4: Article 3 Use of the Sateesfy Donations Service

3.1 Description of the Sateesfy Donations Service

3.1.1 General rules

Every User – every Advertiser declares that they are aware that, in order to access the Sateesfy Donations Service, they must have internet access subscribed to with the provider of their choice, the cost of which is their responsibility, and acknowledges that:

• The reliability of transmissions is random due, in particular, to the heterogeneous nature of the infrastructures and networks on which they travel and that, in particular, failures or saturations can occur;
• It is the Advertiser's responsibility to take any measures it deems appropriate to ensure the security of its equipment and its own data, software or other, in particular against contamination by any virus and/or attempted intrusion of which it may be a victim;
• All equipment connected to the Website is and remains under the sole responsibility of the Advertiser; Sateesfy cannot be held liable for any direct or indirect damage that may arise from their connection to the Website.

The Advertiser undertakes, where applicable, to respect and maintain the confidentiality of the login credentials for its Account and expressly acknowledges that any connection to its Account, as well as any transmission of data from its Account, will be deemed to have been made by the Advertiser.

Any loss, misappropriation or use of login credentials and their potential consequences are the sole and entire responsibility of the Advertiser.

The Advertiser is informed and accepts that for technical reasons, their Advertisement may not be published instantly after being submitted to the Website.

The Advertiser is informed that by publishing their Ad on the website, it may be shared by any User and/or any Advertiser on social networks, via the relevant sharing buttons integrated into the pages.

All published advertisements will be displayed on the website.

3.2 Service Description

The Sateesfy Donations Service offered to Users and Advertisers is the same regardless of whether the Advertiser is a "Private" or "Professional".

1) Non-exhaustive list of features accessible to Advertisers and Users from the Website:

• Viewing all published announcements;
• Connecting with Advertisers;
• The ability to recommend the Ad to a friend;
• Report abuse;
• The Announcement backup;
• Saving my research;
• Sharing an advertisement on social media via the share buttons.

2) Features accessible from the Website to logged-in Individual or professional Advertisers:

• The posting of the advertisement;
• saving ads;
• automatic search for Ads;
• sending the list of currently being broadcast announcements to their email address;
• the modification of the advertisement;
• the geolocation of the property;
• the extension of the Announcements;
• the subscription of Paid Option(s) by bank card and/or by credit;
• the purchase of credits by bank card, electronic wallet or by purchase of prepaid cards;
• the management (updating, modification etc.), at any time, of the personal information entered when creating the Account;
• Required information: name, surname, email, password;
• Optional information: title, age, interests, sector of activity, telephone number, etc.;
• Monitoring of subscribed paid options.

The choice of meeting points for carrying out transactions is made on a case-by-case basis.

3.3. Cookies and Geolocation

To facilitate navigation on the website, cookies may be placed in the communication medium (including computer, mobile phone, digital tablet) of Users in order, for example, to save their search criteria, to pre-fill the submission form (email/phone).

3.4 Protection, collection, use and communication of personal data (in accordance with Law 2010/012 of 21 December 2010 on cybercrime and Law 2010/013 of 21 December 2010 on electronic communications for Cameroon), and all applicable international texts and conventions for other countries.

3.4.1: Protection of personal data

Users and Advertisers of the Sateesfy Donations Service have at any time the right to object, access, rectify, delete and object to the processing of data concerning them (they can exercise this right by contacting Sateesfy via the " contact us " section).

Sateesfy is not responsible for any failure by a third party to respect the Advertiser's refusal to be contacted for commercial purposes and makes no warranty, express or implied, in this regard.

3.4.2: Collection and use of personal data

Posting an advertisement requires the Advertiser to create an account and provide the personal data referred to in a specific paragraph of these Terms and Conditions.

This data may be used by Sateesfy for the following purposes:

• The collection of personal data

Personal data is collected within the framework of:

• From the posting of the Ad by the Advertiser, the latter filling out a form and providing the following information: username, email address, telephone number etc.
• From the creation of the Account, the Individual Advertiser fills out a form and provides the following information: name, surname, email address, etc.

All information contained in the Personal Account profile can be modified at any time by its holder.

• The Professional Advertiser must provide the Company name in the contact form when publishing their advertisement.
• Use of personal data

All personal data collected may be used by Sateesfy for the following purposes:

• the management of the Ad, including its validation;
• the publication and monitoring of the Announcement;
• sending response forms;
• sending commercial and/or promotional offers, originating solely from Sateesfy and relating exclusively to the Sateesfy Donations service;
• sending out satisfaction surveys;
• statistics.

Sateesfy may, within the framework of a census of lost or found objects, people, and documents, and with special authorization from the authorities, reserve the right to publish certain personal data not expressly recorded on the website, such as names, surnames, and images appearing on identity documents. This is for the purpose of allowing for their rapid identification by their owners.

However, any person may request in writing to charity@sateesfydons.com the correction or deletion of information concerning them.

3.4.3 Communication of personal data

Sateesfy is committed to keeping all personal data collected via the Sateesfy Donations service private and not transmitting it to any third party.

By way of exception, the User and the Advertiser are informed that Sateesfy may be required to disclose the personal data collected via the Sateesfy Donations service:

• to authorized administrative and judicial authorities, only upon judicial request,
• to potential Sateesfy branches;

3.4.4 Using our callback request service

By expressly requesting a callback from our agents to report found objects, people, documents, users expressly consent to the use of their transmitted personal data.

Companies, public, semi-public, private religious services, authorized to disseminate or publish personal information such as names and images, by contacting us in the context of a broad dissemination of information via the Sateesfy Dons platform, explicitly authorize us to publish the same information as a relay.

3.5 Unfair commercial prospecting and collection

The use for commercial purposes or public dissemination of data downloaded from the Website is strictly prohibited, under penalty of the criminal sanctions provided.

We invite you to contact us, for any questions or complaints relating to the protection of your privacy and personal data, at our email address available at the bottom of the website's homepage.

#5: Article 4 Moderation of Ads

4.1 Removal of Illegal Advertisements

Sateesfy reserves the right to remove, without notice, compensation, or right to reimbursement, any Advertisement that does not comply with the rules for broadcasting the Sateesfy Donations Service and/or that may infringe upon the rights of a third party, ethics, and good morals.

4.2 Abuse Notification

Any User is permitted to report abusive content from the Website by email by clicking on the link in our email address or by clicking on the "Report abuse" link.

# 6: Article 5 Liability and Guarantees

5.1 Advertiser Commitments

The Advertiser guarantees that it holds all rights (including intellectual property rights) or has obtained all necessary authorizations for the publication of its Advertisement.

The Advertiser guarantees that the Advertisement does not contravene any applicable regulations (including those relating to advertising, competition, sales promotion, the use of languages ​​in force, the use of personal data, the prohibition of the marketing of certain goods or services), nor any third-party rights (including intellectual property rights and personality rights) and that it does not contain any defamatory or harmful message towards third parties.

Thus, the Advertiser undertakes in particular that the Advertisement will not contain:

• no hyperlinks redirecting Users, in particular to websites operated by any third party other than Sateesfy;
• no false, misleading or deceptive information;
• no defamatory statements or statements likely to harm the interests and/or image of sateesfy or any third party;
• no content that infringes on the intellectual property rights of third parties;
• No promotional or advertising content related to the Advertiser's business is permitted. An advertisement is intended to promote a product and is not a form of advertising.

Only paid links (considered advertising) to personal or professional social media pages are allowed.

Promotional events are also permitted.

The Advertiser agrees to only offer available items or goods in the Ads. In the event that an item becomes unavailable, the Advertiser agrees to remove the Ad from the Sateesfy Donations Service as soon as possible.

The Advertiser declares that they are aware of the extent of distribution of the Website, have taken all precautions to comply with the legislation in force in the places of reception and release Sateesfy from all liability in this regard.

In this context, the Advertiser declares and acknowledges that it is solely responsible for the content of the Ads it publishes and makes accessible to Users, as well as for any document or information it transmits to Users.

The Advertiser assumes full editorial responsibility for the content of the Ads it publishes.

Consequently, the Advertiser releases Sateesfy, its subcontractors and suppliers from all liability, guarantees them against any claim or action in connection with the Advertisement that may be brought against them by any third party, and will bear all damages as well as costs and expenses to which they may be ordered to pay or which may be provided for against them by a settlement agreement signed by them with that third party, notwithstanding any damages that Sateesfy, its subcontractors and suppliers may claim as a result of the Advertiser's harmful acts.

By submitting any Ad, each Advertiser acknowledges and accepts that Sateesfy may delete, or refuse, at any time, without compensation or right to reimbursement of sums committed by the Advertiser for the purpose of its submission or the subscription to Paid Options, an Ad that would be contrary in particular to the law in force, to the rules of dissemination of the Sateesfy Donations Service set by Sateesfy and accessible here and/or likely to infringe the rights of third parties, ethics and good morals.

Generally speaking, it is the responsibility of Advertisers to verify their status as an individual or a professional.

In the event of the publication of Ads by an Advertiser registered as an individual, whose activity can be considered as a professional activity, Sateesfy reserves the right to restrict the use of the Sateesfy Donations Service, in particular to refuse or limit the number of Ads that the Advertiser can put online on the Site.

Each advertisement is published on the website for a maximum of 45 days, starting from the day it is submitted. After this period, Sateesfy sends the advertiser an email informing them that their advertisement has expired and is no longer online, and offering them the option to renew it. If the advertiser does not renew their advertisement within 5 days of receiving this email, they will not be able to extend it and will have to submit it again.

The Advertiser also agrees that their Account will not contain:

• no mandatory information false and/or misleading
• no information that infringes on the rights of a third party, ethics and good morals.

In this context, the account holder declares and acknowledges that he/she is solely responsible for the information entered when creating his/her Account.

By creating an Account, each holder acknowledges and accepts that Sateesfy may delete, at any time, without compensation or right to reimbursement of sums committed by the Advertiser for the purpose of subscribing to Paid Options, an account that is contrary in particular to the law in force in its country and/or to the broadcasting rules set by Sateesfy and accessible here.

5.2 Sateesfy's Responsibilities and Obligations

Sateesfy cannot under any circumstances be held responsible for the content of the Ads published by the Advertisers and gives no guarantee, express or implied, in this regard.

Sateesfy is a third party to the correspondence and relationships between Advertisers and Users, and therefore excludes all responsibility in this regard.

5.3 Limitation of Liability

Sateesfy is committed to implementing all necessary means to ensure the best possible provision of the Sateesfy Donations Service to Users and Advertisers.

However, Sateesfy declines all responsibility in the event of:

• interruptions, breakdowns, modifications and malfunctions of the Sateesfy Dons Service regardless of the communication medium used and regardless of their origin and source,
• the loss of data or information stored by Sateesfy. It is the Advertisers' responsibility to take all necessary precautions to preserve the Ads they publish via the Sateesfy Donations Service;
• temporary inability to access the Website due to technical problems, regardless of their origin and source;
• direct or indirect damages caused to the User or the Advertiser, of whatever nature, resulting from the content of the Ads and/or from the access, management, Use, operation, malfunction and/or interruption of the Sateesfy Dons Service;
• abnormal use or unlawful exploitation of the Sateesfy Donations Service by any User or Advertiser;
• computer attack or hacking, deprivation, suppression or prohibition, temporary or permanent, and for whatever reason, of access to the internet network.

Sateesfy's liability shall be limited to direct damages suffered by the Advertiser resulting from a breach of its contractual obligations as defined herein. The User – the Advertiser – therefore waives any right to claim compensation from Sateesfy for indirect damages such as lost profits, lost opportunities, commercial or financial losses, increased overhead costs, or any losses arising from or related to the performance of this agreement.

Each User and Advertiser is solely responsible for any damages caused to third parties and for the consequences of any claims or actions that may arise therefrom. The User also waives any right to take legal action against Sateesfy in the event of legal proceedings brought against them by a third party due to the unlawful use and/or exploitation of the Sateesfy Donations Service, in the event of a User or Advertiser losing their password, or in the event of identity theft.

Users and Advertisers are solely responsible for the transactions thus carried out and their consequences.

#7: Article 6 Intellectual Property

6.1 All intellectual property rights (including, but not limited to, copyright, related rights, trademark rights, and database producer rights) pertaining to both the structure and content of the Website, including but not limited to images, sounds, videos, photographs, logos, trademarks, graphic, textual, and visual elements, tools, software, documents, data, etc. (hereinafter collectively referred to as "Elements"), are reserved. These Elements are the property of Sateesfy. These Elements are made available to Users and Advertisers free of charge, solely for the use of the Sateesfy Donations Service and within the framework of normal use of its functionalities. Users and Advertisers agree not to modify the Elements in any way.

Any unauthorized use of the Website Elements constitutes copyright infringement and may also violate image rights, personal rights, or any other applicable rights and regulations. Consequently, the perpetrator may face civil and/or criminal liability.

6.2 It is prohibited for any User and Advertiser to copy, modify, create a derivative work, reverse engineer or disassemble or otherwise attempt to discover the source code, sell, assign, sublicense or transfer in any way any rights relating to the Elements.

All Users and Advertisers of the Sateesfy Donations Service agree in particular not to:

• use or query the Sateesfy Donations Service on behalf of or for the benefit of others;
• extracting, for commercial or non-commercial purposes, all or part of the information or classified ads present on the Sateesfy Donations Service and on the Website;
• to reproduce on any other medium, for commercial or non-commercial purposes, all or part of the information or classified ads present on the Sateesfy Donations Service and on the Website allowing to reconstitute all or part of the original files;
• using a robot, in particular a web crawler, a search or retrieval application for websites or any other means to retrieve or index all or part of the content of the Website, except in the case of express and prior authorization from Sateesfy;
• copying the information onto media of any kind allowing all or part of the original files to be reconstructed.

Any reproduction, representation, publication, transmission, use, modification, or extraction of all or part of the Elements, in any manner whatsoever, without the prior written authorization of Sateesfy is unlawful. These unlawful acts render their perpetrators liable and may lead to legal proceedings against them, including for copyright infringement.

6.3. The Sateesfy Dons trademarks and logos, as well as the trademarks and logos of Sateesfy's partners, are registered trademarks. Any reproduction, in whole or in part, of these trademarks and/or logos without the prior written authorization of Sateesfy is prohibited.

6.4. Sateesfy is the producer of the databases for the Sateesfy Donations Service. Consequently, any extraction and/or reuse of the database(s) is prohibited.

6.5. Sateesfy reserves the right to take all legal action against persons who have not complied with the prohibitions contained in this article.

6.6. Hyperlinks

6.6.1. Links from the Sateesfy Donations Service

The Sateesfy Donations Service may contain hyperlinks redirecting to sites operated by third parties. These links are provided for informational purposes only.

Sateesfy has no control over these sites and disclaims all responsibility for access to, the content or use of these sites, as well as for any damages that may result from consulting the information on these sites.

The decision to activate these links is the sole responsibility of the User.

6.6.2. Links to the Sateesfy Donations Service

No hyperlink may be created to the Sateesfy Donations Service without the prior and express consent of Sateesfy.

If an internet user or legal entity wishes to create a hyperlink from their website to the Sateesfy Donations Service, regardless of the medium, they must first contact Sateesfy by sending an email to the following address: charity@sateesfydons.com.

Any silence from Sateesfy should be interpreted as a refusal.

6.7. The content of the posted Ads belongs to the Advertisers; however, by posting Ads on the Website, the Advertiser grants:

– to Sateesfy the non-exclusive, transferable, free-of-charge, worldwide right to exploit all the content of the Ads and in particular the photographs, texts, videos, illustrations, trademarks, logos, titles (hereinafter the “Content”), as they are published on the Site as well as a license to all intellectual property rights relating to the Content and in particular the copyrights to the elements used in its Ad, such as photographs, texts, videos, drawings, illustrations, sound elements, and this for the entire legal duration of its intellectual property rights and for the entire world.

The rights thus granted include the right to reproduce, represent, distribute, adapt, modify, create a derivative work, translate all or part of the Content by any means, in any form whatsoever and on any media (digital, printed…) known or unknown to date, within the framework of the Sateesfy Dons service or in connection with the activity of Sateesfy, and this for commercial or non-commercial purposes and in particular for advertising purposes, as well as within the framework of distribution on social networks on which Sateesfy Dons is present and in particular the Facebook and Twitter pages of Sateesfy Dons.

In particular, photographs from the Ads may be reproduced and integrated into advertising formats displayed on the Website, solely in connection with the Ad submitted.

The Advertiser consents to the reproduction of their Advertisement and its Content on social media platforms, including Facebook and Twitter. Therefore, the Advertiser acknowledges having read and accepted the terms of service of Facebook and Twitter, particularly regarding the reuse of Content and personal data.

Under this license, Sateesfy, without creating any obligation to act on its part, has the right to oppose the reproduction and exploitation by unauthorized third parties of the Advertisements published on the Website and their Content.

– to users, the non-exclusive right to access the Content via the Sateesfy Donations Service and to use and display the Content to the extent permitted by the functionalities of the Sateesfy Donations Service, worldwide

# 8: Article 7 Modification of the sateesfy Donations and CGU service

7.1 Sateesfy reserves the right, at any time, to modify or interrupt access to all or part of the Sateesfy Donations Service of the Website.

7.2 Sateesfy reserves the right to modify these Terms and Conditions, in whole or in part, at any time. Users and Advertisers are encouraged to regularly review these Terms and Conditions to stay informed of any changes. Use of the Site by Users and Advertisers constitutes acceptance of any modifications to these Terms and Conditions.

#9: Miscellaneous Provisions

If any part of the Terms and Conditions should prove to be illegal, invalid or unenforceable for any reason whatsoever, the provisions in question shall be deemed unwritten, without affecting the validity of the other provisions which shall continue to apply between Users or Advertisers and Sateesfy.
